As Executor why am I going to do Probate? If you are an Executor then…
Caveats
Entering a caveat is something you do if you believe that Probate has been incorrectly applied for because the person applying is not entitled, there is no Will or there is something about the Will that makes it illegal.
The caveat stops the probate process for 6 months while you prepare and submit your reasons if they are upheld, probate is permanently stopped on that application.
If the caveat is not upheld then depending on where in the process you decide to withdraw the caveat there may be significant costs involved.
Entering a Caveat is both simple and cost effective but be absolutely certain you know what you are doing as getting it wrong can be costly.
Give me a call if you are considering this action.
