Probate Will?
Do you need to apply for Probate if there is a Will? The application for probate is not related to either having or not having a Will but an application to the Government to be allowed to administer that person’s estate. Gov.uk web site gives very clear guidance as to who and why you need to apply or not, but as this can be subject to change it is always best to check the web site at the time. Experience says that having a Will generally improves the process of applying for Probate, as the aspect of who can apply has already been settled by naming an Executor. Not having a Will can throw up the debate of who is going to apply which if things are under dispute could be difficult.
