As Executor why am I going to do Probate? If you are an Executor then…
2 Witnesses
Do I need two witnesses for my Will?
The simple answer is of course Yes you do. Why do you need two, well the idea is that if you have two people witnessing your signature it is twice as hard to get them to say you signed it if you didn’t. Why would you want to do that? You may consider doing this if you want to gain from a Will but don’t gain in the deceased estate is intestate. To create a Will after somebody has passed is a criminal offence so persuading two people they should commit an offence is considered much harder to achieve than persuading one. The people attempting to cheat cannot of course sign the Will themselves as a witness as this will exclude them as a beneficiary. Best plan is to put a Will in place while you are alive and get two independent witnesses to watch you sign it, they must be adults and of sound mind. If you need any help with this then do give us a call as we are more than happy to write the Will and witness it for you.
