LPA why do you need it
Why would you need an LPA.
A Lasting Power of Attorney (LPA) is something that you put in place to ensure that you have a person of your choosing available to make decisions on your behalf if you ever lose the capacity to make them yourself. If you are sensible when you appoint them you will talk to them about what you would like to happen in the situations, they may find themselves in. There is no right time to put an LPA in place because it is impossible to say when, or if, your capacity may be lost. Most people imagine that it will be later in life when they start to live with, say, dementia but it can happen any time in an accident. Almost everyone assumes that family members or long-term partners / spouses have the right to talk on behalf of the person concerned and they are incorrect to think this, unless it is a minor then a parent can talk on behalf of their child. The time this will arise and become difficult is when the family member or long-term partner / spouse disagrees with the official they are dealing with on behalf of the donor. When everyone agrees there is never an issue, but when they don’t you will suddenly find that without an LPA in place you will be doing what the official wants, even if you know that is not what the donor would have wanted.
