Death Bed Gift

You can in fact make a gift from your death bed and it takes effect outside your Will and any provisions of intestacy. There are a few conditions that you need to meet to do this. You must have full mental capacity. You must be expecting to die based on a known situation, not just getting old. The gift is of course conditional on you actually dying. The person making the gift must be able to prove they own the things they are gifting. Having met all these requirements there is still a reasonable chance that somebody will contest the gift as it is likely that the limited number of people involved in this are the people around your bed are the most likely ones to benefit from the gift.
