The answer to this is not actually entirely a Will writing issue it does depend how you got divorced and if you have put in place a financial order. If you just drifted apart and got a divorce to make it official but still talk and looked after the kids in a grown up manner you are more likely not to have a financial order in place and if you compound this by not doing a Will then the chance of a claim on your estate also increases. An ex-spouse can make a claim for “reasonable financial provision” under the inheritance Act of 1975 and if they see your funds going in a direction they don’t like then the claim is much more likely. How do you stop this happening? Get a financial order when you divorce. Get a Will which clearly states what you want to happen to your funds and if you expect a claim you can exclude your ex from your Will making it more unlikely they will fail in a claim If you would like me to talk you through this then give me a call.
