Minors Inheriting

What if my main beneficiaries are under 18?

If the main beneficiaries of your Will are under 18 they are unable to directly inherit, so for this reason we create a minors clause in your Will so that provision can be made for them. The clause creates a trust which remains in place until you feel they are capable of handling the inheritance and are an adult, until then you appoint Trustees to manage and protect the inheritance on their behalf. This trust gives you greater control of circumstances and situations you can plan for. Your Trustees, people you know, are in place to handle anything you cannot or didn’t plan for. If left to minors from an estate with no Will , intestate, then the law makes provision for a trust to be put in place for the minors.  It is less capable than one you can put in place within a Will and it doesn’t take any account of the individual circumstances of your family and your children. It is of course also run by people you haven’t selected and don’t know as they are appointed by the court. If you are looking to protect your children then do get in touch and we can talk you through the options.
