Witnessing a Will

Witnessing a Will requires two adult witnesses, with full capacity, who are not beneficiaries of the Will, nor the spouse or civil partner of the person whose Will is being witnessed. The witnesses must be able to see the person who’s Will is being witnessed sign the Will, then sign the Will themselves in that person’s presence. They also need to provide their full name, address, and occupation. Now that sounds simple doesn’t it, so you will be surprised to hear that it is not unusual that new Will’s need to be produced to recover mistakes made while signing and witnessing takes place incorrectly which is why whenever possible we attend the assignation of a Will.
